Establishing the most appropriate development opportunities for land and buildings can be critical in shaping how a project progresses. Reviewing the development potential and options for land and buildings allows clients to make informed decisions on how/whether to progress a project, how to maximise returns and the likely costs for securing planning consent. Planning policy, planning history, site character and setting will be considered to inform development potential, with the appraisal provided in a clear and understandable manner to the client.

Taking a central role, extensive experience allows for the preparation of robust Planning Statements to justify proposals against planning policy. Created in collaboration with architects and technical consultees as necessary, a cohesive package of information can be submitted as part of a planning applications, giving it the best chance of success.

Close links with many Councils ensures that negotiation can be undertaken to maximise the chances of a positive outcome to a planning application.  

 

If an application is refused, or is undetermined and past its target date, then a planning appeal is an option. Advice can be provided as to whether this is the correct approach and the likely chances of success on appeal.

Taken out of the hands of the Council, detailed justification is provided in support of appeals, to enable the Planning Inspectorate to consider granting consent.

Beta Town Planning Ltd have extensive experience of all three appeal routes: Written Representations, Hearings and Inquiries.  

The General Permitted Development Order, whilst complex, offers an alternative and often simpler and cheaper route to securing consent for extensions, new buildings and changes of use.

Where a medium to long term strategy to secure development is required, promotion of land and buildings through the Development Plan process can be more effective that a windfall planning application.

The likelihood of success of the positive inclusion through Planning Policy Allocation can be provided, long with preparation and advice on a strategy to promote the land, including submission of information and discussion with the Council at key stages, including Call For Sites and Draft Local Plan Consultations.

Where projects have not progressed in line with a planning approval, or consent has simply not been secured, seeking professional advice swiftly is vital. Failure to act can be very costly.

Negotiation with the Council would be undertaken to avoid an Enforcement Notice being served, and if matters cannot be resolved, then an Enforcement Appeal can be submitted, with the aim to secure the necessary consent and quash the Notice.

Many Enforcement Notices have been successfully quashed or amended to allow proposals to be brought in line with an acceptable plan.
